Applying for exemption from administrative rule

The process for requesting exemptions from an administrative rule has changed. School districts most commonly use the exemption process to obtain approval to offer high school courses to eighth grade students for high school credit. The new administrative rule governing the exemption process is ARSD 24:43:08, which will be available for review at http://legis.state.sd.us/rules/index.cfm.

To apply for an exemption from an administrative rule, a school must:

  • Obtain and complete the administrative rule exemption application.
  • Obtain local school board approval of the exemption application (via public hearing).
  • Have both the school principal and the school superintendent sign the application.
  • Send the application to the department.

Waivers may be granted for up to four school years.

Normally, exemption applications for a coming school year would be due to the Department of Education 60 days prior to July 1 of the first affected year. This year, h owever, the department will accept applications until July 1, 2005 . Any applications received after that date will not be accepted.

Beginning with the culmination of the first school year in which a school district has implemented an exemption, the school district must submit an annual report reviewing and assessing the implementation to the department by July 1. The school district must continue submitting an annual report at the end of each year of implementation.
