Part C — Education of Migratory Children

(2) MIGRATORY CHILD- The term migratory child' means a child who is, or whose parent or spouse is, a migratory agricultural worker, including a migratory dairy worker, or a migratory fisher, and who, in the preceding 36 months, in order to obtain, or accompany such parent or spouse, in order to obtain, temporary or seasonal employment in agricultural or fishing work —

(A) has moved from one school district to another;

(B) in a State that is comprised of a single school district, has moved from one administrative area to another within such district; or

(C) resides in a school district of more than 15,000 square miles, and migrates a distance of 20 miles or more to a temporary residence to engage in a fishing activity.

SIMS Definitions

Migrant Education Program (MEP) –  If a child meets the definition above AND the child is enrolled in a migrant education program run by your district.

Migrant Education Summer Program -  If a child meets the above definition, attended a summer education program, and is still enrolled in your school district.  A child who has a yes for this definition will also have a yes coded for one of the other programs also.

Migrant with out Education Program -  If a child meets the definition above but your school does not have a migrant education program OR if the child meets the definition and your school does have a migrant education program, but the child does not need the additional services provided by the program.

Examples:

A child attends a summer education program in your school and is currently enrolled.  Code as “migrant summer education program.” 

  • If this child is receiving migrant services during the school year also code him as “migrant education program” also.
     
  • If this child is not receiving services during the regular school year (assume he no longer needs the services) code him as “migrant with out education program.”

    A migrant child enters your school during the school year.  Your school has a MEP and a summer MEP.
     
  • If the child is receiving services code as “migrant education program”, if not code as “migrant without education program.”
     
  • Even though your school runs a summer program, do not code this child as summer MEP.  He may leave before he gets the chance to attend the summer program.
