Parent consent now required to access student immunization records

To ensure that the South Dakota Department of Health is aligning with the federal Health Insurance Portability and Accountability Act (HIPAA) Omnibus Rule, South Dakota school health officials must obtain a parent, guardian or legal representative agreement before accessing a student’s immunization record within the South Dakota Immunization Information System (SDIIS). No student record shall be accessed in the SDIIS by a school health official without written or verbal parent, guardian or legal representative consent.

The South Dakota Department of Health recently sent a copy of the SDIIS Access Agreement to principals. School health officials receiving verbal agreement must sign and date the form. Signed agreements should be filed in the student’s school file. Failure to obtain a parent, guardian or legal representative agreement prior to accessing a student’s record may result in a corrective action plan, which could include termination of the school’s access to the SDIIS.
